Waiver & Policies - In consideration for my participation in the SkyRide (“Event” as stated below), I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE any of the following: GObike Buffalo, New York State Department of Transportation, The State of New York, Erie County, City of Buffalo and the municipal departments, police departments, fire departments that are involved in the Event; Erie Canal Harbor Development Corporation, Be Our Guest, Ltd., SkyRide affiliates and sponsors; all employees of GObike Buffalo; volunteers, ride leaders and other persons and entities associated with this “Event” from any and all present and future claims including those resulting from ordinary negligence for any property damage, personal injury, death or illness that I and, if applicable, my child might suffer during the SkyRide and other related activities ("Event").

I also waive any and all claims including those resulting from ordinary negligence that may be made by me or my child (if applicable) and my heirs, executors, administrators, other personal representatives or assigns in connection with Event. I attest that I am and, if applicable, my child is physically fit, healthy and cognitively able to participate in this Event and neither I nor my child has been advised otherwise by a qualified medical person. I understand that each child under the age of 18 must ride, volunteer or attend under the immediate and direct supervision of a parent or legal guardian who is also a registered participant.

I understand that I will be using public streets and facilities where many potential hazards exist and I am aware that accidents or injuries may occur during this Event. I am voluntarily participating in this Event with knowledge of all such risks. As a rider, I agree to wear a CPSC-certified helmet and will ensure that my child, if applicable, will wear a CPSC-certified helmet while riding in this Event. I am solely responsible for my personal health and safety and, if applicable, my child’s health and safety, and personal property at all times during the Event.

I will abide by all Event rules, regulations and instructions; and all applicable local, state and federal laws. I consent to receive medical treatment should an injury, accident, illness and/or any other circumstances occur during the Event in which treatment is deemed necessary by qualified medical personnel. I understand that while efforts will be made to accommodate and include all registrants, I may be denied participation due to lack of COVID vaccination based on federal, state, county and local guidelines, regulations, restrictions and/or the discretion of event organizers.

If I observe any unusual hazard and/or physical ailment that may hinder my (or my child’s) participation, I will remove myself from Event participation and notify Event representatives immediately. I agree that Event representatives reserve the right to remove me and/or my child or refuse admission from the Event if, in their sole discretion, they believe that continued participation presents a health or safety risk.

Promotional Agreement: I grant full permission to GObike Buffalo to use the names, photographs and videography of me and/or my child and quotations from me and/or my child in accounts of and promotions, publicity, marketing or advertising for this Event.

I have carefully read this Waiver and Release of Liability and fully understand its contents. I am aware that by signing/or checking yes I agree online to this waiver I am voluntarily agreeing to its terms, including waiving legal rights. Knowing this, I agree to these terms of my own free will.
